FREMONT — A person suspected of brandishing a duplicate gun and yelling dying threats at a freeway motorist whose automobile was adorned with an Israeli flag has been charged with a hate crime and different offenses, in keeping with authorities and courtroom data.

Along with a misdemeanor depend of violation of civil rights, which is a hate crime, the suspect, Jesus Hernandez Hernandez, 44, of Castro Valley, can also be charged with felony prison threats and misdemeanor brandishing a duplicate gun, the data say.

Hernandez is free on his personal recognizance and is scheduled to enter a plea Oct. 31.

Based on authorities the sufferer advised police he was driving on I-680 about 4 p.m. Sept. 12 with an Israeli flag exterior his automobile window when one other motorist in a Ford sedan tried to strike his automobile and started yelling at him in regards to the flag.

The opposite driver yelled “F— the Jews” and “they all deserve to die”  earlier than allegedly pointing a pistol at him and saying “I’ll kill you.” the paperwork say.

The sufferer adopted the suspect off the freeway and onto Fremont metropolis streets whereas calling 911, the paperwork say.

The suspect allegedly pointed the gun once more on the sufferer once more and advised him to cease following him or he would kill him, the paperwork say.

Fremont police stopped the suspect’s automobile within the space of Mission Boulevard and Denise Road and arrested Hernandez. A BB gun was discovered within the automobile.

The sufferer positively recognized him because the suspect in a area lineup. Hernandez refused to speak to police.
