DUBLIN — An Oakland man has been convicted of second-degree homicide within the 2022 taking pictures of a person who had simply been crushed up by the defendant’s father and was working from the San Leandro bar the place the struggle occurred.

Louis Ray Woods III, 35, was convicted of the homicide cost and a gun enhancement for killing Brian Antonio Marquis Moore with an unregistered AR-15-style rifle on March 25, 2022. Throughout trial, Woods’ lawyer argued that it was a case of self-defense primarily based on Woods’ notion that Moore had a gun. Prosecutors known as it premeditated homicide, arguing that Woods shot Moore as has he was making an attempt to run to security.

Jurors started deliberating on Thursday, Nov. 21. They got a spread of costs to contemplate, together with first-degree homicide and voluntary manslaughter, and the second-degree homicide rely they settled on.

Moore was killed outdoors of Cunha’s Cocktail Lounge in San Leandro, a couple of minutes after Woods’ father knocked him down throughout a short struggle contained in the bar. By all accounts, Moore was drunk and disturbing folks within the bar; a bouncer testified that he had been ejected after stripping his clothes off earlier within the night, then reluctantly allowed again in. The bouncer stated he regretted the choice to undo Moore’s ejection as a result of it in the end led to his loss of life.

Prosecutors turned Moore’s erratic habits to their benefit, arguing that the truth that he stripped down proved he was unarmed, and that Woods was mendacity when he claimed Moore had a gun. The protection argued that Moore had retrieved a weapon or been given one after the struggle with Woods’ dad, and that Woods believed his dad was going to be “set up” for beating up Moore.

After the killing, Woods fled to a close-by Motel 6 and tried to keep away from police contact, in keeping with prosecutors. When the cops caught up with him, he lied repeatedly, denying having been to the bar that evening. Solely at trial did he change his story, taking the stand and claiming that somebody outdoors the bar yelled, “he’s caught a gun.”

Woods claimed that he was firing warning photographs, not desiring to hit Moore. The prosecution stated that was simply one other lie, stating that Moore was struck a number of instances, and arguing that he was fleeing along with his again turned when the bullets hit him.
